Sales Terms

These Sales Terms govern every paid subscription to El Engagepublished by TODO_PUBLISHER_NAME. They complement the general Terms of Use, which also apply. In case of conflict, these Sales Terms prevail for matters of subscription, payment and refund.
1. Eligibility
Paid subscriptions are offered to natural persons aged 18 or older, and to legal entities, acting for consumer or professional purposes within the European Economic Area and countries where Stripe (our payment processor) is available.
2. Subscription Plans
We currently offer two paid plans billed on a monthly recurring basis:
- Solo — 15 € / month including applicable VAT. Includes one user slot, one language slot, and a basic progress summary. Monthly provider budget subject to fair use.
- Familial — 25 € / month including applicable VAT. Includes up to three user slots (subscriber + up to 2 invited family members), unlimited language slots, shared monthly provider budget, and detailed progress tracking.
Both plans include a cap of 3 topic regenerations per conversation. Usage is counted by the duration of the active voice session, measured on the server. Unused minutes do not carry over to the next billing period.
3. Orders and Formation of the Contract
The subscription contract is formed when (i) you confirm your order through the Stripe-hosted checkout, (ii) accept these Sales Terms by ticking the dedicated consent box and (iii) the payment is successfully authorised. You will receive an email confirmation containing the invoice.
4. Price and Payment
Prices are displayed in euro and are inclusive of French VAT at the applicable standard rate when the customer is a consumer resident in France. For customers in other EU member states, VAT is applied according to the rules of the country of residence of the consumer, in line with the EU e-services VAT regime. Prices may be adjusted at any time for future billing periods; existing subscriptions are billed at their current price until renewal and you will be notified before any price-change takes effect.
Payment is processed by Stripe Payments Europe Ltd. We do not store card numbers on our servers. Payment instruments accepted are those supported by Stripe at checkout (major credit and debit cards, and any additional methods Stripe enables in your region).
5. Renewal
Subscriptions renew automatically at the end of each monthly period for the same duration and at the same price, unless you cancel before the end of the current period. Cancellation takes effect at the end of the period already paid for; you keep access until then. Cancellation can be performed at any time from your account, through the Stripe customer portal, or by writing to [email protected].
6. Right of Withdrawal (EU Consumers)
You generally have a right to withdraw from a distance contract within 14 days without giving a reason, under Article L.221-18 of the French Consumer Code. However, because El Engage is a digital service whose performance begins immediately with your consent, we ask you, at checkout, to expressly consent to the immediate start of the Service and to acknowledge that you lose your right of withdrawal once the Service has been fully performed, in accordance with Article L.221-28, 13° of the French Consumer Code.
If you have not started using the Service within 14 days of the order and wish to withdraw, send a clear statement to [email protected] within that period. We will reimburse you without undue delay.
7. Refunds
Outside of the right of withdrawal, subscription fees are non-refundable except where required by applicable mandatory consumer law or where we expressly agree (e.g. prolonged service outage attributable to us, duplicate billing).
8. Suspension for Non-Payment
If a renewal payment fails, we will attempt to collect the amount again through Stripe. If payment remains outstanding after Stripe's retry schedule ends, your paid features are downgraded to the free tier. Your account and data are not deleted — you may reactivate at any time by updating your payment method.
9. Changes to the Service or Plans
We may adjust the content of each plan (quotas, features) to reflect changes in underlying AI provider pricing or in operational costs. Where a change materially reduces the value of a plan for existing subscribers, we will notify affected subscribers at least thirty days in advance and allow them to cancel without penalty before the change takes effect.
10. Complaints and Dispute Resolution
Complaints should first be sent to [email protected]. If the dispute cannot be resolved amicably, consumers resident in the European Union may use the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/. French consumers may also refer the matter to a consumer ombudsman in accordance with Article L.612-1 of the French Consumer Code. The name and contact details of the competent mediator will be displayed here once registration is complete.
11. Governing Law
These Sales Terms are governed by French law, without prejudice to the mandatory consumer-protection rules of the country in which the consumer is resident.
