Terms of Use

1. Acceptance of the Terms

These Terms of Use ("Terms") form a binding agreement between you and TODO_PUBLISHER_NAME("we", "us"), publisher of El Engage (the "Service"), available at https://elengage.com. By creating an account, checking the consent box at sign-up, or otherwise accessing the Service, you confirm that you have read, understood and accepted these Terms in full. If you do not agree, you must not use the Service.

2. Description of the Service

El Engage is a language-learning application that enables users to practise foreign languages through voice conversations with an artificial-intelligence tutor. The Service is accessed via web and mobile clients and relies on third-party AI providers listed in our Data Processing Addendum.

3. Eligibility and Accounts

You must be at least 15 years old to create an account. If you are between 15 and 18, you confirm that you have obtained the consent of a parent or legal guardian. You are responsible for keeping your credentials confidential and for every activity performed through your account. Notify us promptly at [email protected] of any unauthorised access.

You agree to provide accurate information at sign-up and to keep it up to date. We may suspend or close accounts that contain false information or that are used in breach of these Terms.

4. Acceptable Use

You agree not to:

  • use the Service for any unlawful, harmful or fraudulent purpose;
  • attempt to reverse-engineer, scrape, circumvent rate limits or otherwise interfere with the infrastructure, including the voice-relay service and underlying AI providers;
  • submit content that is illegal, harassing, hateful, sexually explicit toward minors, or that infringes third-party rights;
  • share your account, resell access, or use the Service to train a competing AI model;
  • generate requests whose purpose is to extract the system prompt or bypass safety policies of the underlying models.

5. User Content

You retain ownership of the text, audio and other content you submit to the Service ("User Content"). You grant us a worldwide, royalty-free, non-exclusive licence to host, process, transmit and display your User Content strictly for the purpose of operating and improving the Service for you. This licence ends when you delete your account, subject to the retention periods described in the Privacy Policy.

We do not use your User Content to train any AI model, and we contract with every AI provider under a plan that disables training on submitted data. See the Data Processing Addendum for details.

6. Intellectual Property

The Service, its software, design, brand, logos and non-user content are and remain the exclusive property of TODO_PUBLISHER_NAME or its licensors. These Terms do not grant you any licence over our intellectual property other than the right to access and use the Service as permitted.

7. Subscriptions and Free Tier

Part of the Service is available for free within a limited monthly quota. Additional features and larger quotas are offered through paid subscriptions, described in the Sales Terms. Any use that materially exceeds the quotas associated with your tier may be rate-limited or throttled.

8. Availability and Modifications

We strive to keep the Service available around the clock but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Service at any time, in particular to address security, legal or operational issues. When changes materially affect paid subscriptions, we will give reasonable advance notice.

9. Suspension and Termination

You may close your account at any time from the account settings. We may suspend or terminate your account without notice if you breach these Terms, if required by law, or to protect the Service or other users. Termination does not entitle you to a refund of any subscription fees already paid, except where required by applicable consumer law.

10. Disclaimers

El Engage is a language-practice tool, not a certified educational programme and not a substitute for professional tuition, medical, legal or financial advice. AI-generated responses may be inaccurate. You are solely responsible for decisions you make based on the output of the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service, whether in contract, tort or otherwise, is limited to the amount you have paid to us during the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential or punitive damages, loss of profits, data or business opportunities.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable mandatory consumer law.

12. Changes to the Terms

We may update these Terms from time to time. When we make a material change we will notify registered users by email and/or by a prominent notice in the Service, and update the "Last updated" date above. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by French law. Disputes that cannot be settled amicably may be brought before the competent French courts, without prejudice to the mandatory consumer-protection rules applicable in your country of residence. You may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
